You Are Talking to AI

3AM is an artificial intelligence system, not a human. Nothing you hear during a conversation comes from a person monitoring or responding to you in real time.

Voice and Conversation Data

3AM uses ElevenLabs Conversational Agents to power voice interactions — this includes converting your speech to text, generating the audio you hear, and managing the flow of the conversation. Your voice audio is processed by ElevenLabs' API to enable this.

3AM uses Claude, built by Anthropic, to generate the reasoning behind each response. The text of your conversation is sent to Anthropic's API to generate what 3AM says back to you.

3AM itself does not record, store, or retain any audio or conversation data after your session ends. We do not keep a history of what you've said, and there is no account or profile tied to your conversations.

Microphone Access

3AM requests microphone access solely to enable voice conversations. Microphone access is only active while you are speaking during a session. 3AM does not independently record or store audio beyond what is needed to process your conversation in real time as described above.

Analytics

We do not use tracking pixels, advertising cookies, or behavioral analytics. We do not know who you are, where you are, or what you talked about.

Donations

If you choose to make a donation, payment is processed securely by Stripe. We receive confirmation that a donation was made but we do not store your payment details. Stripe's privacy policy governs payment processing.

Third Party Services

3AM relies on the following third-party services to function:

• ElevenLabs — processes your voice audio to enable speech recognition and generate spoken responses. See ElevenLabs' privacy policy for how they handle this data.
• Anthropic — processes the text of your conversation to generate Claude's responses. See Anthropic's privacy policy for how they handle this data.
• Stripe — processes donation payments. See Stripe's privacy policy for how they handle this data.

Neither ElevenLabs nor Anthropic receives your name or other identifying information beyond what is spoken or typed during your conversation. Each company's own privacy policy and data retention practices govern how they handle data on their end — 3AM does not control or have visibility into their internal retention windows, which may include brief, standard retention for abuse and safety monitoring separate from what 3AM itself stores (which is nothing).

Children

3AM is intended for use by adults 18 and older only. It is not designed for, directed at, or intended for use by anyone under 18.

3AM does not collect, store, or retain any personal information from any user, of any age. Conversations are not saved or recorded. Because we do not collect data, we have no way to independently verify a user's age.

If you are under 18, please do not use 3AM. Please talk to a parent, guardian, school counselor, or a resource built for young people, such as Crisis Text Line (text HOME to 741741, available anytime).

If we become aware that a user is under 18, we will take steps to prevent continued access.
